Acceptance of Orders

All orders are subject to written price verification by authorized personnel of Apoyarfutbol, unless designated in writing as firm for a specific period. The shipment of goods without written price verification does not imply acceptance of the order price.

Substitutions

Apoyarfutbol reserves the right to substitute a product with an alternative of similar type, quality, and function without prior notice. If substitutions are not acceptable, the Buyer must specify this when requesting a quote or placing an order.

Prices

Quoted prices, including freight charges, are valid for 10 days unless otherwise specified in a written quote or acceptance of sale. Apoyarfutbol reserves the right to cancel orders if government regulations establish lower prices than those quoted.

Shipping and Transportation

Unless otherwise specified, Apoyarfutbol will select the carrier and determine the shipping route. Apoyarfutbol shall not be liable for any delay or additional transportation costs resulting from the selected shipping method.

Packaging

Apoyarfutbol will follow its standard packaging practices unless the Buyer requests otherwise. Any additional cost for special packaging, loading, or securing requested by the Buyer shall be borne by the Buyer.

Payment Terms

Any discount applies only to the invoiced value of the goods, excluding taxes and freight charges. Apoyarfutbol reserves the right to require payment in advance or satisfactory security if the financial condition of the Buyer warrants it. Failure to make payments according to the agreement may result in order cancellation, and the Buyer shall remain responsible for outstanding accounts payable.

Taxes and Licenses

Prices do not include taxes. The Buyer is responsible for the payment of taxes unless a valid exemption certificate is provided. The Buyer is also responsible for obtaining any required import or export licenses.

Title and Risk of Loss

The risk of loss transfers to the Buyer at the time of delivery to the carrier. Claims for damage during shipping must be made directly to the carrier. Title to the goods remains with Apoyarfutbol until full payment is received, including all applicable charges.

Product Returns

Products cannot be returned or orders canceled without first contacting Apoyarfutbol's customer service. Customized items and special orders cannot be returned unless they were provided in error by Apoyarfutbol. The Buyer is responsible for transportation charges on returned goods.

Force Majeure

Apoyarfutbol shall not be liable for failure to perform its obligations due to circumstances beyond its control, including but not limited to, natural disasters, acts of government, war, riots, or transportation delays. In the event of shortages, Apoyarfutbol may allocate its available supply among its customers in a fair and reasonable manner.

Attorney Fees

In the event of legal action to recover the purchase price or any unpaid balance, or due to the Buyer’s breach of any term herein, the Buyer agrees to pay reasonable attorney fees and collection costs of Apoyarfutbol.

Liability

Apoyarfutbol shall not be liable for any injury or damage resulting from the use or application of its products. Claims for errors in weight or quantity must be made within fifteen (30) days of receipt. If the claim is valid, Apoyarfutbol may ship the necessary quantity or credit the Buyer accordingly.

Warranty

All goods sold by Apoyarfutbol are guaranteed to be free from defects in materials and workmanship, in accordance with industry standards. This warranty is not transferable and excludes all other warranties, whether express or implied. Apoyarfutbol's liability under this warranty is limited to the repair or replacement of defective goods or the refund of the purchase price.

Remedies and Limitation of Liability

Apoyarfutbol shall not be liable for incidental or consequential damages arising from the sale or use of its products. Apoyarfutbol's liability is limited to the replacement of goods, a refund of the purchase price, or the repair of the goods.

Product Selection

The Buyer represents that the products purchased are suitable for their intended use and assumes all responsibility for their application. The Buyer agrees to indemnify and hold Apoyarfutbol harmless from any claims or liabilities arising from improper use or installation of the products.

Partial Refunds

Partial refunds may be offered on returned items that are missing original parts. The amount of the refund will be determined based on the condition of the returned item.
